Definitions

In this disclosure statement:

• Personal Data: Any information related to an identifiable or identifiable real person.
• Sensitive Personal Data: Information regarding race, ethnic origin, political opinions, beliefs, religion, sect or other beliefs, clothing, association, foundation or union membership, health, sexual life, criminal convictions, security-related data, as well as biometric and genetic data.
• Personal Data Protection Law (KVKK): Law No. 6698 on the Protection of Personal Data, which entered into force upon publication in the Official Gazette on April 7, 2016.
• Data Processor: A real or legal person who records personal data on behalf of the Data Controller based on authorization.
• Data Controller: A real or legal person who determines the purposes and means of processing personal data and is responsible for establishing and managing the data recording system.

ELEGANT GÜNTAY TEKSTİL DIŞ.TİC.LTD.ŞTİ., as the Data Controller, informs you within the scope of KVKK regarding the identity of the data controller, examples of processed personal data, processing characteristics, retention periods, third-party and/or international transfers, methods and legal reasons for data processing, and rights granted under KVKK.

What Personal Data Do We Process?

Examples of personal data we process:

• Personal Data Provided by You: Name, surname, date of birth, Turkish ID number, phone number, email address, address, and any other personal data shared through surveys, photo and video recordings, or other communication channels.
• Automatically Collected Personal Data: Data collected through automated search engines, image and audio recording devices, cookies, or other automated tools.
• Personal Data Obtained from Other Sources: Updated delivery and address information, account details, purchase history, page views, search terms, and search results shared by social media platforms, business partners, suppliers, and other third parties based on prior consent.

Personal Data Retention Period

Your personal data is retained in accordance with KVKK and other relevant legislation for the mandatory periods specified. If no specific retention period is defined, personal data is stored for as long as necessary for the purpose of processing. Once the reason for processing ceases to exist, the data is deleted, destroyed, or anonymized.

Purposes of Processing Your Personal Data

Your personal data is processed based on your explicit consent. However, in accordance with the fundamental principles set forth by KVKK, it may also be processed without your explicit consent under Article 5.2 and Article 6.3, for purposes such as fulfilling legal obligations, establishing or executing a contract, protecting legitimate interests, ensuring efficient resource use, and improving customer service quality.

Additionally, personal data that you have publicly shared through competitions or social media channels may be processed within the scope permitted by KVKK without requiring further consent.

Processing of Your Personal Data

Your personal data may be processed within the scope of Article 5.1 and Article 6.2 of KVKK, provided that your explicit consent is obtained. Additionally, since our programs and memberships offer exclusive advantages to members, by enrolling in these programs or memberships, you provide explicit consent for the processing of your personal data, except in exceptional cases.

Based on this explicit consent, your personal data may be processed for purposes such as internet advertising, targeting, re-targeting, cross-selling, campaigns, promotions, and product/service advertisements tailored to you. This includes the use of cookies to offer personalized commercial proposals based on your preferences and recent purchases.

Furthermore, your data may be processed to:

• Determine how you discovered our websites,
• Generate non-anonymous traffic statistics based on unique user records,
• Enhance website usability and functionality,
• Recognize you during website visits and provide personalized browsing experiences,

Access to Your Personal Data and Your Rights Under KVKK

 

Rights Under Article 11 of KVKK

Under Article 11 of the Personal Data Protection Law (KVKK), you have the right to apply to ELEGANT GÜNTAY TEKSTİL TİCARET LTD. ŞTİ. and:

• Learn whether your personal data is being processed,
• Request information if your personal data has been processed,
• Learn the purpose of processing and whether your data is used in accordance with that purpose,
• Know the third parties to whom your personal data has been transferred, whether domestically or internationally,
• Request correction if your personal data has been processed incompletely or incorrectly,
• Request deletion or destruction of your personal data if the reasons requiring its processing no longer exist,
• Request notification of corrections, deletions, or destruction to third parties to whom your data has been transferred,
• Object to any unfavorable outcome arising from the exclusive analysis of your personal data through automated systems,
• Demand compensation if your personal data has been processed unlawfully and you have suffered damages as a result.

To exercise these rights, you may submit your request via secure electronic signature to our email address ‘…….com’, or deliver a wet-signed petition in person or via notary along with identity verification documents.

ELEGANT GÜNTAY TEKSTİL TİCARET LTD. ŞTİ. will process your request free of charge within 30 (thirty) days at the latest. If fulfilling the request incurs additional costs, fees determined by the Personal Data Protection Board may be charged.

If your personal data is processed based on explicit consent, withdrawing your consent may result in the termination of membership/loyalty programs that require such processing, and you may no longer benefit from related services.

Your application must be clear and understandable, including identity and address verification documents, and submitted in writing, signed, and delivered in person, by mail, or via notary to ……../Istanbul.
